Reminder - OSHA 10 Hour Course Required On New York Public Work

Just a reminder that effective July 18, 2008, New York Labor Law Sec. 220-h will take effect. The new law requires that on all public works projects of at least $250,000.00, all laborers, workers and mechanics working on the site must be certified as having successfully completed the OSHA 10-hour construction safety and health course. Also, the new law mandates that the advertised bids and contracts for every public works project of at least $250,000.00 must contain a provision setting forth the OSHA training course requirement.

What action will the labor department take if they find a worker without the certification?

To the best of my knowledge, the Department of Labor has yet to formulate enforcement rules and regulations with respect to the OSHA requirement. The Department states that they will be posted on its website when enacted. I presume that employer fines will be part of any remedial action.

I took the OSHA 10 hour construction course online at www.osha10hourtraining.com, and found the process to be much more pleasant than I first thought it would be. I confimed the course is OSHA approved, of course, and got my OSHA 10 hour wallet card through the mail. It actually was fun
